Terms & Conditions

Participation in this promotion (including any and all components thereof, the “Promotion”) is subject to the general terms and conditions and specific terms conditions set forth below (the “Rules”). By participating in the Promotion, participants agree to be bound by the Rules, which agreement constitutes a binding agreement between participant, on the one hand, and Sky Warrior Bahamas Limited (“Baha Mar”), on the other hand.

Section A: General Terms and Conditions

  1. All participants (i) must be eighteen (18) years of age or older; (ii) must not be prohibited from gaming or entering the Baha Mar Casino and/or the Baha Mar Resort by law or for any other reason; (iii) must not be (a) an employee of Baha Mar, CTF BM Operations Ltd., Perfect Luck Assets Limited, their respective hotel managers, or of the foregoing entities’ parents, subsidiaries, affiliates, or successor companies (collectively, the “Entities”); or (b) a Household Member or Immediate Family Member of such employee. A “Household Member” shall mean a person who shares the same residence as an employee of any of the Entities. An “Immediate Family Member” shall mean a parent, step-parent, child, stepchild, sibling, step-sibling, or spouse of any of the foregoing; (iv) must not be entered into certain self-limit, self-exclusion, and/or dissociated persons program in any jurisdiction (or otherwise prohibited from participating by applicable law); and (v) must agree to release and hold harmless the Releasees (as defined herein) from any and all liability for any loss or damage of any kind to person or property, arising in whole or in part, directly or indirectly, from participation in the Promotion.
  2. By participating in the Promotion, and to the fullest extent permitted by law, each participant understands, acknowledges, and agrees to the following: (i) participation in the Promotion is conditioned upon the participant’s compliance with the Rules; (ii) the participant releases and holds harmless CTF BM Operations Ltd., Sky Warrior Bahamas, Limited, Perfect Luck Assets Limited, the licensor/management entities of each of the hotel brands located at the Baha Mar Resort, as well as each of the foregoing entities’ parents, affiliates, subsidiaries, advertising and promotion agencies, and all of their agents, officers, directors, shareholders, employees, and insurers (individually and collectively, “Releasees”) from any and all liability, losses, obligations, claims, actions, settlements, awards, compensation, fees, expenses or damages of any kind, to person or property, resulting in whole or in part, directly or indirectly, from participation in the Promotion; (iii) in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond Baha Mar’s reasonable control, corrupt, prevent or impair the ability of Baha Mar to fulfill any component of the Promotion, Baha Mar has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Promotion; (iv) the Releasees are not responsible for typographical or other errors in the Promotion or the Rules; (v) any portion of the Promotion not accepted or used by participant will be forfeited; (vi) Baha Mar has the right, in its sole discretion to, at any time, revoke any offer made to any individual pursuant to the Promotion where it believes the individual is engaged in violating, or may violate, the Rules or the Privacy Policy. Additionally, Baha Mar may, at any time, revoke any offer made to any individual pursuant to the Promotion for any other reason as determined solely by Baha Mar which includes, but is not limited to, a belief by Baha Mar that a participant is or has engaged or may be about to engage in unfair, fraudulent, deceptive, and/or misleading actions, omissions, behavior and/or conduct related to the Promotion. All disputes, claims and causes of action at law or in equity arising out of, or relating to, the Promotion or the meaning or interpretation of the Rules shall be resolved by applying the laws of The Commonwealth of the Bahamas (“The Bahamas”), without regard to conflicts of laws provisions therein, and shall be solely and exclusively brought in the Supreme Court of The Bahamas. By participating in the Promotion, participant consents to the jurisdiction of the Supreme Court of The Bahamas. All of the foregoing agreements and releases survive termination of the Promotion and/or the Promotion Period (defined below).
  3. Privacy Information provided to Baha Mar in connection with the Promotion is subject to Baha Mar’s privacy policy.
  4. Reservation of Rights; Void Where Baha Mar reserves the right to suspend, modify, or cancel the Promotion or the Rules in its sole discretion. Baha Mar has the right to modify the eligibility requirements for the Promotion at any time during the Promotion. The Promotion is subject to all applicable laws and regulations of The Bahamas and is void where prohibited by law.
  5. Prohibition on Transfer. The Promotion (including, without any limitation, any components thereof) may not be exchanged, sold, or transferred. No substitutions shall be made for any component of the Promotion.

Section B: Specific Terms and Conditions

  1. Promotion The Promotion will be held from June 19, 2023 at 5:00 a.m. Eastern Time to December 31, 2023, at 4:59 am Eastern Time while towel supplies last (the “Promotion Period”).
  2. In addition to fulfillment of the General Terms and Conditions contained herein, in order to be eligible to receive a prize, each participant: (a) must be a member of Club Blu; and (b) must earn at least 1,500 qualifying slot points through play on Qualifying Slot Machines (as defined below) during a single stay at Baha Mar (“Qualifying Period”). A “Qualifying Slot Machine” or “Qualifying Slot Machines” means any slot machine or machines located on the Baha Mar casino floor excluding any skill-based table game related slot machine or machines including, but not limited to, a poker, blackjack, roulette or craps slot machine.
  3. Participants who earn at least 1,500 slot points on a Qualifying Slot Machine during a Qualifying Period will be eligible to receive a Baha Mar branded beach towel (a “Prize”) while towel supplies last. Only one prize will be awarded to a qualifying participant per Qualifying Period.
  4. Qualifying Participants can only earn qualifying slot points when using their Club Blu Card, which must be properly inserted into a Qualifying Slot Machine in order to receive credit for the slot points earned through play during the Qualifying Period. Only slot points earned during a single Qualifying period will be counted toward the 1,500-point minimum required to become eligible to receive a Prize. Slot points do not carry over to a subsequent Qualifying Period. Participants cannot combine points from multiple Club Blu accounts to become eligible for a Prize. Participants may only win a prize once per Promotional Day.
  5. Prize Distribution. Prizes must be collected from the Club Blu Rewards Desk. Participants are required to produce their Club Blu card or a valid form of identification for verification before they can receive a Prize. Participants will only be eligible to receive a Prize while Prize supplies last.
